The Website is not a service contract
This is the most important thing to understand about these Terms.
Information on the Website, including service descriptions, pricing ranges, promotions, and any estimate request you submit, is provided for general information only. Nothing on the Website constitutes a binding quote, a guarantee of price, or a contract for work.
Plumbing work is quoted only after a licensed technician evaluates the actual conditions at your property. Any work we perform for you is governed by a separate written agreement signed by you and by us, which will set out the scope of work, the price, the payment schedule, and the warranty. Where California law requires a written home improvement contract, that separate written agreement controls, and if anything in these Terms conflicts with it, the signed agreement takes precedence.
Submitting a form on the Website or requesting an appointment does not create a contract and does not obligate either of us until we have agreed on the work in writing.
Scheduling, arrival windows, and emergency service
We schedule appointments in arrival windows rather than at exact times, because job durations vary and emergencies take priority. We make reasonable efforts to arrive within the window given and to notify you of delays, but we do not guarantee a specific arrival time.
Emergency service is offered outside of standard business hours and may be billed at a different rate. Any emergency rate will be disclosed to you before work begins.
Estimates, pricing, and payment
Estimates are based on the conditions visible and accessible at the time of evaluation. Plumbing systems frequently conceal conditions that cannot be seen until work is underway, such as pipe corrosion behind walls, root intrusion, prior non-conforming repairs, or slab conditions. If we discover a condition that materially changes the scope or cost, we will stop, explain it to you, and obtain your written authorization before continuing.
Payment terms are set out in your written agreement. Unless that agreement says otherwise, payment is due on completion of the work.
Warranty
We stand behind our workmanship. The warranty applicable to your job, including its length and what it covers, is stated in your written agreement. Manufacturer warranties on parts, fixtures, and equipment are provided by the manufacturer and are subject to that manufacturer's terms.
Warranties do not cover damage caused by misuse, neglect, alteration by others, work performed by another contractor, freezing, ground movement, or conditions outside the scope of the work we performed. No warranty is created by anything on this Website. Warranty terms come only from your written agreement.

We will not ask you to agree to any provision that penalizes you for writing a negative review. California law protects your right to make truthful statements about your experience with a business.
Links to other websites
The Website contains links to sites operated by others, including map providers, review platforms, manufacturers, and directories. We provide these links for convenience. We do not control those sites, we are not responsible for their content, accuracy, or practices, and a link does not imply endorsement. Your use of any linked site is at your own risk and subject to that site's own terms.
Website provided as is
THE WEBSITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM EVERY WARRANTY OF ANY KIND REGARDING THE WEBSITE, WHETHER STATED OUTRIGHT OR IMPLIED BY LAW. THIS DISCLAIMER COVERS THE IMPLIED WARRANTIES OF MERCHANTABILITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF TITLE, AND OF NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, OR THAT ITS CONTENT IS ACCURATE, COMPLETE, OR CURRENT.
This section applies to the Website only. It does not disclaim any warranty on plumbing work we actually perform for you, which is governed by your written agreement, and it does not limit any right you have under the California Business and Professions Code or other consumer protection law that cannot be waived.
Accuracy of information
We work to keep the Website accurate and current, but we do not guarantee that it is. Service descriptions, availability, service areas, and pricing information may contain errors or become outdated. We reserve the right to correct any error and to change Website content at any time without notice.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AQUA PRO ROOTER, INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE WEBSITE. THIS INCLUDES DAMAGES FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE KNEW OR SHOULD HAVE KNOWN THAT SUCH DAMAGES WERE POSSIBLE.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE WEBSITE WILL NOT EXCEED ONE HUNDRED DOLLARS (100.00 USD).
These limitations apply to your use of the Website. They do not limit our liability for the plumbing work we perform, for personal injury, for fraud, for gross negligence or willful misconduct, or for any liability that cannot be limited or excluded under California law. Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless Aqua Pro Rooter, Inc. and its officers, employees, and agents from any claim, loss, liability, or expense, including reasonable attorneys' fees, arising out of your misuse of the Website, your violation of these Terms, or your violation of any law or the rights of a third party. This does not apply to claims arising from our own negligence or misconduct.

Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute connected with these Terms or with the Website will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.
Nothing in this section deprives you of the protection of any mandatory California consumer protection law, or of your right to bring a qualifying claim in small claims court.
Class action waiver
TO THE EXTENT PERMITTED BY LAW, YOU AND AQUA PRO ROOTER, INC. EACH AGREE TO RAISE ANY WEBSITE RELATED CLAIM ONLY ON AN INDIVIDUAL BASIS. NEITHER OF US WILL PURSUE OR JOIN A CLASS, COLLECTIVE, OR CONSOLIDATED PROCEEDING AGAINST THE OTHER, WHETHER AS A NAMED PARTY OR AS A MEMBER OF A PROPOSED CLASS.
This waiver does not apply to any claim that cannot be waived under California law, including representative claims that California law expressly permits. If this section is found unenforceable in whole or in part, the remainder of these Terms will continue in effect.
Severability and entire agreement
Should a court find any part of these Terms invalid or unenforceable, that part will be narrowed to the minimum extent needed to make it enforceable, or removed if narrowing is not possible, and everything else will stay in full force.
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
These Terms, together with our Privacy Policy and Cookie Policy, together form the complete understanding between you and us concerning the Website. They do not replace or modify any signed written agreement for plumbing services, which controls the work itself.
Changes to these Terms
We may revise these Terms at any time. The revised version takes effect when posted, and we will update the "Last updated" date at the top of this page. Your continued use of the Website after a change means you accept the revised Terms. Please review this page periodically.
